Ibinasura ng Department of Justice (DOJ) ang kasong kriminal na isinampa laban kay dating Bureau of Customs (BOC) Commissioner Nicanor Faeldon at 11 pang opisyal ng kagawaran kaugnay sa P6.4 bilyong shabu shipment mula China.
Ayon kay Justice Secretary Vitaliano Aguirre, dinismis ng prosecution panel na pinamumunuan ni Assistant State Prosecutor Aristotle Reyes ang kasong isinampa ng Philippine Drug Enforcement Agency (PDEA) dahil sa kawalan ng ‘probable cause.’
Kabilang sa mga kasong ibinasura ang conspiracy to import illegal drugs and protecting or coddling of drug traffickers sa ilalim ng Republic Act 9165 (Comprehensive Dangerous Drugs Act), negligence and tolerance sa ilalim ng Article 208 ng Revised Penal Code, at corrupt practices of public officers sa ilalim ng Section 3 of R.A. 3019 (Anti-Graft and Corrupt Practices Act).
Ginamit ng DOJ na basehan sa pagbasura ng kaso ang pagkabigo na linawin ang ‘omission’ na umano’y ginawa ng mga kinasuhan.
“Further, the evidence adduced by the PDEA in support of the charges were insufficient to establish probable case. Thus, the Panel is constrained to take into consideration the defense raised by the respondents,” base sa resolusyon.
Bukod kay Faeldon, kasama rin inabsuwelto sina BOC Director Milo Maestrecampo, Director Neil Estrella, Intelligence Officer Joel Pinawin, Intelligence Officer Oliver Valiente, Atty. Jeleena Magsuci, Atty. Philip Maronilla, Alexandra Y. Ventura, Randolph O. Cabansag, Dennis J. Maniego, Dennis Cabildo at John Edillor.
Samantala, isinampa naman ng DOJ ang kasong kriminal na importation of dangerous drugs sa ilalim ng Section 4, in relation to Section 26 (a) of Republic Act No. 9165 sa Regional Trial Court of Valenzuela City laban kina Customs broker Mark Taguba at siyam na iba pa.
Base sa resolusyon, kinakitaan ng ebidensiya sa krimen na ‘importation of dangerous drugs’ sa ilalim ng Section 4 of Republic Act No. 9165 kilala bilang Comprehensive Dangerous Drugs Act of 2002, ang mga respondents na sina Chen Ju Long a.k.a. ‘Richard Tan’ or ‘Richard Chen’, Li Guang Feng a.k.a. ‘Manny Li’, Dong Yi Shen Xi a.k.a. ‘Kenneth Dong’, Mark Ruben G. Taguba II, Eirene Mae A. Tatad, Teejay A. Marcellano, Chen I. Min, Jhu Ming Jhun, Chen Rong Huan, at iba pang ‘di kilalang indibiduwal na John Doe, Jane Doe at George Doe.
