Pinawalang sala ng Court of Appeals (CA) ang komed­yanteng si Jose Manalo.

Ito’y tungkol sa multimillion-peso case na sangkot ang kanyang estranged wife na si Annalyn.

Sa March 28 resolution, inab­suwelto ng appellate court ang TV host/comedian na may pananagutan umano ito sa PHP50-million compromise agreement sa pagitan ni Annalyn at businessman Froilan Clemente Jr.

Ibinasura ng CA ang motion for reconsideration na isinampa ni Clemente at pinagtibay ang ­unang desisyon na ang komedyante ay hindi sangkot sa settlement deal.

“To repeat, the compromise agreement was signed by only one of the two defendants: Annalyn. On the other hand, herein private res­pondent Ariel or Jose, her husband and co-defendant, was not made a party to the settlement with the plaintiff, Froilan,” ayon sa desisyon ni Associate Justice Ma. Luisa Quijano-Padilla.

Ayon sa CA, hindi umano maituturing na balido ang kasunduan dahil walang pahintulot ang komed­yante.

“More importantly, the main provisions of said compromise agreement involve admissions of liabilities and assumption of obligations made by Annalyn, not only for herself, but also on behalf of her husband Ariel, even if the latter was not made a party to the settlement. This is contrary to law because the element of consent, on the part of private respondent, is lacking,” ayon pa sa korte.

Pinawalang bisa ng CA ang January 26, 2018 desisyon na nilabas ni Quezon City Regional Trial Court Branch 92 Judge Eleuterio Bathan.
