Kinumpirma ng Commission on Audit (COA) ang nauna nilang desisyon kaugnay ng P1.5 milyong notice of disallowance ng National Irrigation Administration (NIA) Regional Office No. 1 kaugnay ng sobrang ibinayad na incentive noong 2011.
Sa desisyon ng COA Commission Proper, ibinasura nito ang apela ng NIA kasama ang ang isinampa ni dating regional irrigation manager Manuel Collado dahil lagpas na ito sa prescribed period.
“Based on the foregoing, petitioners had already exhausted the reglementary period of six months or 180 days to file the Petition for Review under Section 48 of Presidential Decree (PD) No. 1445 and Section 3, Rule VII of the 2009 Revised Rules of Procedure of the COA,” sabi sa desisyon .
Bunsod nito, sinabi ng COA na ‘final and executory’ na ang desisyon kung saan binanggit pa nito ang 2 SC case na Aguilar vs Court of Appeals, et al at Guido-Enriquez vs Victorino.
Gayunman, kung gagamitin ang merito ng kaso, sinabi ng COA na ibabasura pa rin nito ang apela ng mga akusado.
“The CAN (Collective Negotiation Agreement) incentive for the year 2011, which ranges from P15,500.00 to P62,000.00 for each employee, exceeded the threshold amount,” sabi ng COA alinsunod sa DBM Budget Circular No. 2011-5 na nag-aatas na hindi kailangang lumagpas sa P25,000 ang ibabayad na insentibo.
