Proseso sa pagkuha ng titulo

Ma’am magandang umaga po. Puwede po ba makahingi ng tulong regarding po sa lote namin dito sa Biñan, Laguna?

Mangyari po kasi ‘yung lote namin ay walang technical narrative des­cription. Nagpunta na po ako sa Land Management Bureau pati na rin po sa Land Registration Authority gayundin sa Department of Environment Natural Resources sa Laguna pero wala rin akong makuha.

Ano po ba ang dapat kong gawin? Sana naman po ay matulungan niyo ako.

Magandang araw po!
Sa dating po ng inyong sulat ay lumalabas na wala pang titulo ang inyong lupa. Hindi ninyo rin po nasabi kung may Declaration of Real Pro­perty na makukuha ninyo sa Assessor’s Office na sumasakop ng inyong lupa.

Mas mainam kung ang inyong lupa ay kinikilala na ng Assessor’s Office at nagbabayad na kayo ng amilyar (real property tax) dahil mayroon na po tayong pagbabasehan ng sukat ng inyong lupa. At ito po ang mga dapat na maihanda ninyo kung sakali na balak na ninyong patituluhan ang inyong lupa:

1) Survey of land by the Bureau of Lands or a duly licensed private surveyor;

2) Filing of application for registration by the applicant;

3) Setting of the date for the initial hearing of the application by the court;

4) Transmittal of the application and the date of initial hearing together with all the documents or other evidences attached thereto by the Clerk of Court to the Land Registration Commission;

5) Publication of a notice of the filing of the application and date and place of hearing once in the Official Gazette and once in a newspaper of general circulation in the Philippines;

6) Service of notice upon contiguous ow­ners, occupants and those known to have interest in the property by the Sheriff;

7) Filing of answer or opposition to the application by any person whether named in the notice or not;

8) Hearing of the case by the Court;

9) Promulgation of judgment by the Court;

10) Issuance of the decree by the Court declaring the decision final and instructing the Land Registration Commission to issue a decree of confirmation and registration;

11) Entry of the dec­ree of registration in the Land Registration Commission;

12) Sending of copy of the decree of registration to the corresponding Register of Deeds; and

13) Transcription of the decree of registration in the registration book and the issuance of the owner’s duplicate original certificate of title of the application by the Register of Deeds, upon payment of the prescribed fees.

Lahat po ng iyan ay dapat magawa upang ang korte ay magsagawa ng desisyon na mag-uutos na ang Original Certificate of Title (OCT) ay ma-issue sa inyong pangalan. Ang OCT po ang kauna-unahang title na mairerehistro sa isang lupang hindi pa napapatituluhan.
