Ibinasura ng Department of Justice (DOJ) ang P38.5 milyong tax evasion case laban kay Richard Gutierrez, kasunod na rin ng ginawang pagbasura sa kasong falsification of public documents at perjury ng aktor na isinampa noong 2017.

Sa ipinalabas na resolusyon ni Assistant State Prosecutor Christine Perolino, sinabi nito na hindi sapat ang ebidensiya ng Bureau of Internal Revenue (BIR) para idiin sa kaso si Guttierez.

“As we find complai­nant’s evidence inadequate to sustain a fin­ding of probable cause for falsification against the res­pondent, there is no necessity to dwell and discuss the other charges because the same hinged on whether falsification was attendant in this case. Hence, there is no outcome but the dismissal of case,” nakasaad sa re­solusyon.

Una nang inakusa­han si Gutierrez nang pagsusumite ng pekeng annual income tax return para sa taong 2012 at quarterly value added tax returns para sa ikalawa at ikaapat na quarter ng 2012 na umano’y paglabag sa Article 172 ng Revised Penal Code.

Matatandaan na si Gutierrez at ang kanyang kompanya na RGUTZ Productions Corporation ay sinampahan ng kasong paglabag sa Tax Code ng BIR.
