Tanging ang Korte Suprema at Court of Appeals lamang ang maaaring makapag-review sa naging desisyon ng National Telecommunications Commission (NTC) na ipatigil ang operasyon ng ABS-CBN dahil sa napasong prangkisa.
Ito ang inihayag ni Presidential Spokesman Harry Roque sa harap ng pananaw ng ilang abogado na may magagawa si Pangulong Rodrigo Duterte kung nais nitong mabago ang naging desisyon ng NTC.
Ayon kay Roque, nakasaad sa batas na hindi maaring utusan ng Kongreso ang NTC na baligtarin o bawiin ang desisyon para makapag-isyu ng provisional franchise para sa ABS- CBN dahil ang komisyon ay isang quasi -judicial body, at tanging ang Kataas-taasang hukuman at Court of Appeals ang maaaring mag-review sa mga desisyon nito .
“The issue is whether or not the NTC can be compelled as Congress wants to issue a provisional franchise. We’ve examined the law in this regard, and the NTC’s decisions are not even reviewable by the Office of the President. They can only be reviewed by our courts, either the Court of Appeals or the Supreme Court, ” ani Roque.
Batid aniya ni Pangulong Duterte ang magkaibang pananaw nina Justice Secretary Menardo Guevarra at Solicitor General Jose Calida sa issue at hindi siya makikialam dahil kapag ginawa niya ito ay may malalabag siyang batas.
Sinabi ni Roque na nakausap niya ang Presidente nitong Martes ng gabi hinggil sa isyu ng ABS-CBN franchise ,at binigyang-diin na ang usapin ay nasa NTC.
Ang tanging remedyo ani Roque ay makakuha ng panibagong franchise ang nabanggit na TV network sa Kongreso.
“The actual remedy of ABS-CBN lies in the House of Representatives because I think the senate can even approve the franchise bill in a days’s time assuming the House will approve it,” dagdag ni Roque.(Aileen Taliping)
