Paglilinaw ni Senate Minority leader Franklin Drilon, na kahit nasa ilalim ng Martial Law o suspendido ang privilege of the writ of habeas corpus, hindi pa rin maaaring gawin ang warrantless arrest maliban na lamang sa may mga kasong rebelyon sa korte.
“Even under Martial Law or despite suspension of the privilege of the writ of habeas corpus, warrantless arrest cannot be done except those charged in court with rebellion,” ayon kay Drilon, na dating justice secretary.
“I hope that Justice Mendoza was just misquoted. I remind him that the Constitution and the rule of law should continue to reign supreme,” ayon kay Drilon.
“The Bill of Rights cannot be set aside even under Martial Law or even when the privilege of the writ of habeas corpus is suspended. There are rights that are considered inviolable under the present Constitution. Those rights should be respected at all times,” giit ni Drilon.
Dahil dito, ayon sa senador, kahit na suspendido ang privilege of the writ of habeas corpus ay hindi pa maaaring gawin ang warrantless arrest maliban sa krimeng rebelyon.
